<p>Young adults are the most uninsured demographic of any group in the United States. 30% of young adults are not insured today. Uninsured young adults are two times as likely as those with private insurance to have no schooling past the point of high school. That limits their future earnings potential.</p>

There are strict rules and regulations that a debt collector must abide by, and if any of these regulations are violated, there&#8217;s a good chance that you could sue that agency. But what about that friend of yours who owes you five dollars? Do you have to grant them thirty days to refute the claim? Clearly, you do not.</p>
<p>The point is that the Fair Debt Collection Practices Act applies to collectors, and only collectors. For example, take a look at Morency v. Evanston Northwestern Healthcare Corp, a district court case in Illinois from 1999. In an attempt to collect debt, a hospital issued and sent out pre-collection notices, which is a no-no for third party collectors. But the court ruled that the hospital was merely a creditor, not a collection agency, so the FDCPA did not apply to it.</p>
<p>Courts take a lot of factors into consideration to determine whether the creditor should be considered the actual debt collector. A collection agency&#8217;s participation in the actual debt collection would have to be small. Is the collection agency only mailing service? Do the letters say if the debtor does not pay the debt will be referred for collection? Is the collection agency paid only for sending letters, rather than commission?</p>
<p>If the collection agency does not receive any payments or forwards payments to the creditor, that&#8217;s always suspicious. If a debtor fails to respond to the letter and the collection agency has no further contact with the debtor, or if it does not receive the files of the debtors, they probably aren&#8217;t going to be considered debt collection agencies.</p>
<p>The lesson you should take away from this is that it is important that you know who you are paying your money to. It&#8217;s always wise to be vigilant when it comes to your finances.</p>

An all around failure, the program stopped a few weeks ago after it cost taxpayers $69,000 to settle a federal lawsuit. The state auditor halted the program because it wasn&#8217;t generating any income.</p>
<p>Despite this fact, these counties are now discussing re-starting the program by collecting booking fees. Financial analysts remain dubious. Even in the best case scenarios, the policy may not be lucrative at all as many prisoners that end up in jail have no money.</p>
<p>Lawsuits were the issue that first put an end to the program. An Ohio jail that was in the vicinity began charging booking fees for one hundred dollars and an additional $67.77 daily charge for every day held. But federal lawsuits against Hamilton and Butler counties started the end of &#8220;pay to stay&#8221; programs. The main issue at hand was determining who had to pay the fee.</p>
<p>Ohio law allows a county to charge inmates for room and board, medical and dental treatment, property damage and a onetime booking fee. Prisoners must be billed at the end of their stay, but the most important provision of the law is that convicted inmates only could be charged. The District Judge said that it was unconstitutional to take these fines from inmates who were not yet convicted.</p>
<p>Hamilton County was taken to court in 2000 and was advised to refund about one million dollars in prison fees and to pay $150,000 for an educational program for prisoners. In 2001, Butler County was sued too. By 2003, the grand total of money that was returned to settle law costs was $63,846 to 2,431 inmates. Also, the county was ordered to pay a $5,000 donation to the Legal aid Society after officials did not add the agreed upon ten percent interest on refund checks.</p>
<p>Even though the plan to charge pay to stay fees to prisoners has failed, and has cost taxpayers more money than the program is worth, the Sheriff&#8217;s department still is considering measures to make more money from the jail. Charging booking fees, and taking in out of state prisoners are ideas that they are currently thinking about.</p>

<p>U.S. Bankruptcy Court records illustrate that there were 27,413 bankruptcy petitions filed in Wisconsin in 2008. More than 80% were Chapter 7 cases. Chapter 7 cases take out medical bills, credit card balances, and other types of debt. Recent Research by The Associated Press illustrated that more than 1.4 million bankruptcies were filed in 2009, an increase of about 32% from 2008.</p>
<p>And although bankruptcy takes care of the looming debt and gives debtors a fresh financial start, consumers often remain unemployed and are not able to find any new type of employment to get an acceptable income again.</p>
<p>As if that wasn&#8217;t enough, unless the economy gets good enough for industries to start hiring again, there isn&#8217;t much reason to believe that bankruptcies will go down in 2010. Analysts have mentioned that home foreclosures will continue to pile up in 2010 because people who previously had adequate credit have lost employment and cannot keep up with payments.</p>
<p>Bankruptcy might look like a good option to get start anew, but it has a negative effect on your credit report for ten years, which might hurt your chances to get a car, place of residence, or employment. Bearing in mind the number of recent lawsuits against bill collectors, ACA International, the largest trade group of professional creditors and collectors, alleges more and more collection companies are working towards training collectors to take a more of an empathetic position.</p>
<p>Empathy may just be the plan of action that can turn the industry around. A large number of people who owe money are being called by various collections agencies, and if they do obtain money, they are not going to want to give it to the aggressive threatening collector, they will give it to the person they can work with.</p>
<p>As agencies are enhancing training courses to include techniques on how to be gentler with consumers, a focus is being put on coaching, mentoring and counseling debtors, rather than aggressively threatening them. Trainees are encouraged to reflect on their personal experiences with collectors or someone that they know has dealt with them.</p>
<p>One trend in the industry has been to suggest that people who owe money talk to their parents or grandparents about taking out a loan against their life reverse mortgage insurance policies against their house. The collectors who practice this technique claim that our grandparents remember the Great Depression. They may not want this generation to feel that kind of pain and may be more apt to take a loan against the life retirement account or the life insurance policy.</p>
<p>Collectors who practice this philosophy think that it is in actuality a positive thing. They think that it doesn&#8217;t hurt anyone. If a person borrows against life insurance it may be preferable to borrowing against a 401(k) or a retirement plan. This is because the person will be counting on that money to survive.</p>
<p>Right or wrong, it could do the collections industry some good to reassess its situation, and look for new innovative ways to collect in a suffering economy.</p>

Hammer, it turns out that Cash4Gold may not in fact be too legit to quit.</p>
<p>In recent news, Representative Anthony D. Weiner fingered Cash4Gold because of their bad business practices. Making a speech in front of jewelry appraisers that were legitimate, Weiner requested consumers to take their business to a place that they knew was valid as opposed to the shady mail in gold exchange.</p>
<p>The way that Cash4Gold works is that consumers utilize special envelopes to send jewelry and gold to the company&#8217;s offices in Florida. The advertisements claim the business will provide customers with a quick appraisal of the value of the items they have sent, and then they will mail them a check for that amount.</p>
<p>On paper, consumers are given a twelve day time span in which they have the ability to return their check and get the jewelry back. But according to research by Rep. Weiner and Consumer Reports, Cash4Gold paid out only 11 to 29 percent of the actual value of valuables sent to them, and often, they refused to mail jewelry back when it was requested to do so within the 12 day period.</p>
<p>Weiner urged the Federal Trade Commission to look into the whole Cash4Gold problem, adding that he planned to introduce legislation that could regulate companies that use mail to exchange cash and jewelry.</p>
<p>This legislation would put fines on companies that melt down gold without the owner&#8217;s permission or before a return period has been passed. It will make companies allow enough time for consumers to request a refund and make sure that companies actually insure the jewelry they are returning to consumers.</p>

<p>Right now there is a great deal of risk aversion when it comes to credit cards, said Dan North, chief economist at Euler Hermes ACI, a trade credit insurance firm.</p>
<p>The credit scare started last fall. As a result, people have commenced utilizing their credit cards less, meaning less interchange profit from transactions. The credit card firms have also become protective, chiseling credit lines, increasing fees and modifying interest rates from fixed to fluctuating, both in response to the need for more revenue now and to prepare for the restrictions from the Credit Cardholders Bill of Rights, which goes into effect next year.</p>
<p>According to North, Discover cardholders have fragile credit ratings, on a whole, than holders of MasterCards, Visas and American Express cards, though those companies are struggling the same financial challenges.</p>
<p>All of those elements have also made it hard for a new competitor in the market, Revolution Money, a payment platform complete with credit card and money transfer service planed to compete with major card companies Visa, MasterCard, Discover and American Express. Revolution LLC, headed by AOL founder Steve Case, had longed to compete mainly by offering better security through a chip-based card and lower interchange fees to merchants.</p>
<p>A group of niche players that are gaining more traction now, according to a Scripps Howard News Service report, is peer-to-peer lending (P2P), which completely bypasses traditional financial institutions. P2P lending services bundle pledges from individual investors and offer small loans to other individuals at attractive rates, a model that could evolve into direct competition for credit cards.</p>
